What Is the Timeshare Rescission Period?

The timeshare rescission period is a short window after purchase when you may be allowed to cancel the contract without having to prove fraud or fight over the reason.

The deadline is usually only a few days. The exact number depends on the state laws that apply to the purchase and the terms in your contract. That means you need to move quickly.

How Do You Cancel a Timeshare During the Rescission Period?

Start with the contract. Somewhere in the documents, there should be cancellation instructions. Look for language about:

• Right of rescission
• Cancellation period
• Notice of cancellation
• Where to send the notice
• How the notice must be delivered
• Whether the deadline is based on mailing or receipt

Follow those instructions closely. If the contract says to mail the notice to a specific address, use that address. If it says certified mail, use certified mail. If it requires specific contract information, include it.

What Should the Cancellation Notice Say?

Your timeshare cancellation letter does not need to be long. It should clearly state that you are canceling the timeshare contract within the rescission period. Include basic details such as:

• The date of purchase
• The contract number, if available
• The resort or timeshare company name
• A clear statement that you are canceling the contract

Why Proof Matters

If the timeshare company later claims it did not receive your cancellation, you need proof.

• Email confirmation, if email cancellation is allowed
• Copies of the contract and cancellation instructions
• Any response from the timeshare company

Do not hand over your only copy of anything. Keep your own file.

Should You Call the Salesperson?

You can call if you want, but do not rely on the call to cancel your timeshare.

A salesperson may try to talk you out of canceling. They may offer bonus points, a lower payment, or another meeting. They may say they will “take care of it” for you.

That is not enough.If you want to cancel during the rescission period, do it in writing and follow the contract.

Do You Need a Timeshare Attorney During the Rescission Period?

Not always. If you are clearly within the cancellation window and the contract instructions are easy to follow, you may be able to send the notice yourself. But a timeshare attorney can help if:

• The company will not give you straight answers
